Grant Burchnall operating as The Greedy Farmer (“the Greedy Farmer”) welcomes you to the Greedy Farmer website (the “Site”) and subscription service (the “Subscription Service”). By using the Website and Subscription Service (collectively referred to as the “System”) you are agreeing to comply with and to be bound by the following terms of use. Please review the following terms carefully. If you do not agree to these terms you should not use the System.
These Terms of Service (the “Terms”) govern your use and access to the System. By using the System in any manner, you (a “User” or “you”) acknowledge that you have read all of these Terms and agree to be bound by them, including the Greedy Farmer’s Privacy Policy, which is incorporated herein by reference.
You agree to the Terms with respect to the Site and System. This Terms of Service Agreement (the “Agreement”) constitutes the entire and only agreement between the Greedy Farmer and the User, and supersedes all prior contemporaneous agreements, representation, warranties and understandings with respect to the Site, System, the content, goods and services provided by or through the Site and/or System, and the subject-matter of this Agreement. Users agree to review this Agreement prior to using the System. The Greedy Farmer may amend this Agreement from time to time, without specific advance notice to you. The latest Agreement will be posted on the Site, and you should review the Agreement prior to using the site.
To use the System you must be at least 18 years old and have the legal authority to accept these Terms.

The Greedy Farmer disclaims any and all warranties, express or implied, of any kind, regarding the Site and/or Subscription Services (including without limitation its software, functionality, or of any content contained therewith), as to title, non-infringement, accuracy, completeness, accessibility, compatibility, suitability, reliability, availability, timeliness, quality, merchantability, fitness for a particular purpose or lack of viruses.
You agree that any information you provide to the System may be lost or destroyed, and that the Greedy Farmer is not responsible for the loss of such information.
The Greedy Farmer has reasonable security measures in place to protect against the loss, misuse and interception by third parties of the information under its control. Despite this complete confidentiality and security is not possible over the internet. The Greedy Farmer assumes no liability for any damages the User may suffer as a result of loss, interception, alteration or misuse of information you provide us or any information transmitted over the internet, Site or System.
The Greedy Farmer cannot ensure that the information and System, Site and Subscription Services are free of bugs and/or errors and/or problems and/or other limitations. The Greedy Farmer further disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the System. You expressly agree that any use or access of this Site is at your sole risk and responsibility. Neither the Greedy Farmer, nor any of its affiliates, officers, executives, directors, employees, licensors, agents, representatives, and shareholders warrant and/or guarantee that the content, information, materials, Services, or products of the Site or System are accurate, current, complete and/or that access to the Site will be uninterrupted or error-free or free of bugs, security breaches, virus attacks, and like nature or that the Site and its servers are free from harmful components. Except as expressly stated in the Greedy Farmer Privacy Policy, it does not make or provide any representations, warranties or conditions of any kind, express or implied, as to the security of any information you may provide or activities you engage in during the course of your use and/or access of the System. You assume total responsibility for your use of the System and any linked sites.
The Greedy Farmer website has secure areas which require a personal username, email and password. Each user is solely responsible for his/her username, email and password. It is the user’s responsibility to notify the Greedy Farmer if others know this data. The Greedy Farmer can block access to your personal file until another username, email and/or password have been confirmed.
Links to third-party websites
3.1 The System may contain links to other third-party websites that are not owned or controlled by the Greedy Farmer. The Greedy Farmer is not responsible for the content, accuracy or opinion expressed in such websites. Inclusion of any linked website on the System does not imply approval or endorsement of the linked website by the Greedy Farmer. You should exercise caution and look at the terms of use applicable to the website in question. You release the Greedy Farmer from any and all liabilities and damages arising from your use of, or reliance upon any third-party services, material or websites, which are provided to you solely on a convenience basis.
4. Intellectual Property Rights
4.1. With the exception of User’s personal information and information found on third party websites, all content of the Site and Subscription Service, including but not limited to the text and images thereof and their arrangement, are owned, controlled, duly attained or licensed by or to the Greedy Farmer and are protected under applicable copyrights and other proprietary laws, including but not limited to intellectual property laws. The Greedy Farmer retains by ownership, control or license all title and interest in the intellectual property rights contained in any Greedy Farmer materials and software on the Site and Subscription Service, including but not limited to copyright, database rights, trade dress, service marks, website graphic design, graphics, user interfaces, visual interfaces, photographs, text, documents, descriptions, products, interactive features, videos, user submissions, button icons, trademarks, logos, trade or business names, goodwill associated with any of the foregoing, sounds, artwork, computer code, design, structure, selection, coordination, organization, arrangement and other matters related to the System, and other similar rights or contents or obligations whether registered or not in any jurisdiction in the world.
4.2. The copying, reproduction, use, modification or publication by you of any such materials or any part of the System in any form or by any means is strictly prohibited. By accepting these Terms, you hereby undertake not to do so and/or attempt to do so and/or assist anyone else in doing so. In case you wish to copy, print, save or download any content and/or information solely for your personal use, you must retain all copyright and other proprietary notices contained therein.
4.3. You agree not to modify, rent, lease, sell, distribute, or create derivative works based on the Greedy Farmer System, in any manner, and you shall not exploit the Greedy Farmer’s Subscription Service in any unauthorized way.
4.4. All other trademarks not owned by the Greedy Farmer or its subsidiaries (if any) that appear on the System are the property of their respective owners.
5. System Functionality
5.1 The Greedy Farmer System operates through the use of real time buy/sell notifications. Users are provided with full access to the Greedy Farmer’s share portfolio and its historic performance. With the use of the real time buy/ sell notifications they can mimic the trades of the Greedy Farmer.
5.2 The Greedy Farmer also publishes periodic bulletins with comments and thoughts on market conditions, and factors which may impact the market. These bulletins are opinions, and are to be reviewed and relied upon at the Users own risk.
6. Accounts & Billing
6.1. Subscription- Subscription fees for the use of the Greedy Farmer System will be a yearly fee billed annually. The subscription fee is subject to change based solely on the discretion of the Greedy Farmer.
6.2. Suspension – Your account will remain in effect until it’s cancelled for any reason or terminated by you. If your billing information and payment source is invalid or if charges billed to you are declined, your account may be suspended or cancelled, at the Greedy Farmer’s discretion. If charges are not paid, such account may be cancelled and all of the User’s personal information may be deleted.
6.3. Fee Changes – the Greedy Farmer may change the fees in effect in its sole discretion and without notice. Notwithstanding the foregoing, as Users are enrolled in an automatic renewal subscription they will receive an advance notice of these changes via a message to the email address associated with their account, in accordance with applicable law.
6.4. Automatic Renewal – In order to ensure that you do not experience an interruption or loss of the System, all Users are enrolled in an automatic renewal subscription. The automatic renewal subscription automatically renews the System for the following year. Therefore, unless you cancel your subscription, the Greedy Farmer will automatically renew the System when it comes up for renewal, and will take payment from the payment method you have on file with the Greedy Farmer at the Greedy Farmer’s then current rates, which you acknowledge and agree may be higher or lower than the rates for the original service period. You may cancel your subscription for the System prior to the automatic renewal at any time. In such event the services shall be discontinued upon the expiration of the respective period you have paid for and you shall not have any claims towards the Greedy Farmer in relation to the discontinuation of the services.
6.5. Cancellation & Refunds –You are free to stop using the Greedy Farmer System at any time and terminate your account completely by emailing the Greedy Farmer directly at Grant@greedyfarmerinvesting.ca to terminate your subscription. The Greedy Farmer reserves the right to suspend or end the Services at any time in its sole discretion and without notice, if you are not complying with these Terms, or use the System in a manner that would cause the Greedy Farmer legal liability, disrupt the System or disrupt others’ use of the System, or in case the Greedy Farmer is obligated to do so according to any applicable law.
The Greedy Farmer System is provided on a prepay basis. In order to cancel your paid account services please contact the Greedy Farmer at Grant@greedyfarmerinvesting.ca to do so. The date of any cancellation shall be the date on which the Greedy Farmer received the User’s cancellation notice via email. When your account is cancelled you will be removed from the system, and your subscription will not be auto-renewed for the upcoming year. There are NO REFUNDS for the year that you have already paid for.
If you believe that you have been incorrectly charged, please contact the Greedy Farmer at Grant@greedyfarmerinvesting.ca in writing within 30 days of the received receipt containing the charge in question.
7. Prohibited Uses
7.1 User’s may not forward, sell, lease, furnish or share the information presented by the Greedy Farmer and may not permit access to the Greedy Farmer’s website to others. The Greedy Farmer’s communications are not to be resold or passed on gratuitously. Any sharing of the Greedy Farmer’s investing information is subject to permission granted to the User by the Greedy Farmer.
7.2. In addition, under any circumstance you shall not: (i) use the System in any manner or for any purpose other than as expressly permitted by these Terms; (ii) engage in any unlawful or fraudulent activity or perpetrate a hoax or engage in phishing schemes or forgery or other similar falsification or manipulation of data; (iii) send unsolicited or unauthorized junk mail, spam, chain letters, pyramid schemes or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (iv) modify, decompile, reverse engineer, disassemble, publish, create derivative works, copy, distribute, disseminate, transmit, broadcast, display, license, sell, use any of this System’s content or frame this System within any other site, nor use meta-tag searches or perform any activity that would damage the operation of the System or otherwise exploit for any purposes whatsoever the System’s content, information and source-code, including attempt to derive the source code of, modify, or create derivative works of the license, including any updates or any part thereof; (v) collect content or information from the System, or otherwise access the System, by using any automated means, including without limitation, “spiders”, “offline readers”, “robots”, and “scrapers”; (vi) disrupt the servers or networks connected to the System; (vii) disable, circumvent, directly or indirectly, or otherwise interfere with security related features and contents of the System or features and contents that prevent or restrict use or copying of any content or that enforce limitations on use of the System; (viii) harvest or collect any personal identifiable information from the System; and (ix) use the System, directly or indirectly, for any commercial purposes or commercial solicitation purposes.
8. Limitation of Liability
8.1 To the fullest extent permitted by law, in no event will the Greedy Farmer or any of its subsidiaries, affiliates, officers, executives, directors, employees, licensors, agents, representatives, and shareholders be liable for any direct, indirect, special, incidental, punitive, exemplary or consequential damages arising from your use of the System or any other claim related in any way to the Subscription Services, nor to any emotional or physical distress, loss of use, data, goodwill, reputation, opportunity, personal injury, social harm, business, or profits, regardless of the legal or equitable theory upon which the claim is based, even if advised or warned of the possibility thereof in advance.
10.2 The Greedy Farmer’s entire liability and your first and exclusive remedy is to discontinue your use of the Site and Subscription Services. Notwithstanding the above, the Greedy Farmer’s aggregated liability for any actual damages and all claims relating to the Subscription Services or arising from or related to the Site, whether in contract or tort or otherwise, shall be limited to the aggregate amount actually paid by you to the Greedy Farmer in the past 12 months immediately preceding the bringing of the claim against the Greedy Farmer. You further consent and agree that any claim or cause of action which you may have with respect to the Greedy Farmer and/or its affiliates, officers, executives, employees, agents, and shareholders must be commenced within two (2) year after the claim or cause of action arises. Because some jurisdictions may not allow the exclusion or limitation of liability stated above, in such jurisdictions, the Greedy Farmer’s liability shall be the limitation set out in therein.
11. Indemnity
You agree that you shall indemnify, defend and hold the Greedy Farmer, its, officers, directors, shareholders, executives, employees, attorneys, representatives, agents, subsidiaries and affiliates, harmless from any and all demands, loss, liability, damages, claims, actions, causes of action, suits, proceedings, obligations cost or expenses (including reasonable attorneys’ fees), arising from or relating to the use and receipt of: (i) the Site, and/or receipt of Subscription Services, (ii) your violation of these Terms and/or Privacy Policy, (iii) your violation of any third party right, made against due to or arising out of or in connection with your use of the System and/or receipt of the Services.
This Section shall survive any termination of these Terms.
12. Non- Transferable
The User’s right to use this Site is not transferable. Any password or right given to the User to obtain access is not transferable.
13. Resolving Disputes
We want to address your concerns. Before filing a claim against the Greedy Farmer, you agree to try to resolve the dispute by contacting us at Grant@greedyfarmerinvesting.ca. We’ll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 15 days of submission, then the dispute will be settled by arbitration in accordance with the Arbitration Act as then in place in Alberta Canada.
14. Editing, Deleting and Modification
The Greedy Farmer reserves the right in its sole discretion to edit or delete any documents, information or other content appearing on the Site.
15. General
Governing Law & Jurisdiction. These Terms and Agreement shall be treated as though it were executed and performed in the Province of Alberta, and shall be governed by and construed in accordance with the laws of the Province of Alberta (without regard to conflict of law principles). Any cause of action of the User with respect to the System must be instituted within two years after the cause of action arose or be forever waived and barred.
Entire Agreement. These Terms constitute the entire agreement between you and the Greedy Farmer with respect to the System, and supersede and replace any other prior or contemporaneous agreements.
Waiver, Severability & Assignment. The Greedy Farmer’s failure to enforce a provision is not a waiver of its right to do so later. If a provision of these Terms or the Privacy Policy is found to be unenforceable, the remaining provisions of these Terms or the Privacy Policy will remain in full effect and the enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. The Greedy Farmer may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the System.
Modifications. The content of this System, including these Terms, is subject to modification or change at any time by the Greedy Farmer, at its sole discretion. Users are advised to periodically check the Greedy Farmer’s Terms and Privacy Policy for any updates. Any modification or change shall be effective upon posting by the Greedy Farmer on the Site, and you agree to be bound to any such changes or modifications when you use and/or access the Site after such changes are posted.
